Terms of Use

This English translation is provided for your convenience. The Japanese version is the official version. If the two differ, the Japanese version prevails.

These Terms of Use (the "Terms") set out the conditions for using the smartphone app "Focus Cafe" (the "App") provided by LibeTech (the "Operator"). Anyone who uses the App (a "User") must agree to these Terms before using it.

Article 1 (Scope)

These Terms apply to all relationships between the Operator and Users regarding the use of the App. The handling of information is governed by the separate Privacy Policy.

Article 2 (Accounts)

  1. Users sign in with an Apple or Google account to use the App.
  2. Without signing in, Users can use part of the App (such as focusing on their own) as a guest. Guests cannot create rooms, join rooms with an invite code, chat, report, block, or purchase FocusCafe Plus, and are not shown in the rankings. When a guest signs in, their records carry over as they are.
  3. Guest data is deleted automatically 7 days after it was created if the guest has never focused, or 90 days after the last focus session if the guest has focused.
  4. Users must manage their own accounts at their own responsibility and must not let any third party use them.
  5. Minors must obtain the consent of a parent or guardian before using the App.

Article 3 (Prohibited conduct)

When using the App, Users must not:

  1. Harass, defame, threaten, or make discriminatory remarks toward other Users
  2. Post obscene or violent content, or any other content contrary to public order and morals
  3. Post their own or anyone else's personal information (such as addresses, phone numbers, or contact details)
  4. Advertise, solicit, spam, or direct others to other services
  5. Seek romantic or sexual encounters, or engage in inappropriate conduct toward minors
  6. Impersonate others
  7. Violate laws or regulations, or engage in conduct that leads to crime
  8. Place excessive load on the App or its servers, access them without authorization, or exploit bugs
  9. Copy, modify, or analyze the App (except as permitted by law)
  10. Engage in any other conduct the Operator deems inappropriate

Article 4 (Handling of posts)

  1. The User who posts a chat message is responsible for its content.
  2. Chat messages are deleted 7 days after they are sent.
  3. The Operator may hide or delete messages without notifying the User when they are reported or when the Operator determines that they fall under prohibited conduct.

Article 5 (Reporting, blocking, and suspension)

  1. The Operator does not tolerate inappropriate posts or Users who cause trouble for other Users.
  2. Users can report inappropriate posts or conduct to the Operator and block other Users. Posts by a blocked User immediately stop appearing on the blocking User's screen.
  3. When the Operator receives a report or block, it reviews the content within 24 hours and, as needed, deletes the post and suspends the User who posted it.
  4. If the Operator determines that a User has violated these Terms, or may do so, the Operator may suspend that User's use of the App temporarily or indefinitely without prior notice.

Article 6 (Rooms)

  1. An invite-only room is managed by the User who created it (the "owner"). If the owner closes the room or deletes their account, the room is removed and the Users who had joined it can no longer enter.
  2. The owner can remove members from an invite-only room. A removed User can enter again with the invite code. However, Users blocked by the owner cannot enter with the invite code.
  3. The background chosen by the owner is shown to all Users who enter the room.

Article 7 (FocusCafe Plus)

  1. The App offers "FocusCafe Plus" ("Plus"), an auto-renewing subscription that unlocks paid backgrounds, avatar items, and more.
  2. Plus has monthly and yearly plans. Prices are shown on the purchase screen in the App. There is no free trial period.
  3. Payment is charged to the User's Apple or Google store account when the purchase is confirmed.
  4. Unless canceled at least 24 hours before the end of the current period, Plus renews automatically on the same plan, and payment is charged at each renewal.
  5. To cancel, use the subscription settings of each store. After canceling, the User can continue to use Plus until the end of that period.
  6. Cancellations of purchases and refunds are subject to the rules of each store. Except as required by law, the Operator does not issue refunds.
  7. By watching ads, Users may be able to try paid backgrounds for a limited time. The Operator may change the length and conditions of these trials.

Article 7-2 (Use via the App Store)

For Users who obtained the App from the App Store, Apple's Licensed Application End User License Agreement applies in addition to these Terms. If these Terms and that agreement differ, that agreement prevails with respect to the license to use the App.

Article 8 (Rest tickets)

"Rest tickets" can only be used within the App to keep a streak. They cannot be exchanged for money or transferred to other Users. The Operator may change the conditions and number of tickets given.

Article 9 (Account deletion)

Users can delete their account at any time from within the App (guests use "Delete guest data"). Once deleted, focus records, rooms, settings, and other data cannot be restored. Deleting an account does not automatically cancel Plus, so please cancel it first from the settings of each store.

Article 10 (Changes to, suspension of, and termination of the App)

The Operator may change the content of the App or temporarily suspend it without prior notice to Users. If the Operator ends the App, it will announce this in the App or on the Operator's website with reasonable advance notice.

Article 11 (Disclaimer)

  1. The Operator does not guarantee that the App is free of bugs or interruptions, or that it is fit for a User's purpose.
  2. The Operator is not responsible for disputes between Users.
  3. The Operator is not liable for damages to Users arising from the use of the App, except in cases of the Operator's intent or gross negligence. Even where the Operator is liable, the amount is limited to the amount the User paid to the Operator in the month in which the damage occurred.

Article 12 (Changes to these Terms)

The Operator may change these Terms as needed. When it does, it will announce the changes and the date they take effect in the App or on this page. Using the App on or after that date means the User agrees to the revised Terms.

Article 13 (Governing law and jurisdiction)

These Terms are governed by the laws of Japan. Any dispute relating to the App is subject to the exclusive jurisdiction, as the court of first instance, of the district court having jurisdiction over the Operator's location.
